Vojko v Multiweld Engineering
https://www.caselaw.nsw.gov.au/decision/549fa09f3004262463b300b8
Vojko sustained a life-changing injury during the course of his work as a fitter and welder. He attended a highly advertised legal practice to assist him with his claim. Their advice caused him to elect to accept a small sum of worker’s compensation and forfeit his common law rights.
Prior to the accident Vojko was young and fit. His injuries caused a major urological dysfunction, and his loss was substantial, as he was unfit to return to manual employment and there were significant ongoing costs for treatment.
We assisted him to have his initial election set aside and helped him pursue a damages claim for negligence against his employer for unsafe work practices. He was awarded a substantial sum, more appropriate to his losses.
